Representative Tom Marino (R-PA) sponsored H.R. 2641, the Responsibly and Professionally Invigorating Development (RAPID) Act of 2013, which would severely undermine the National Environmental Policy Act (NEPA) compromising the quality of environmental reviews and interfering with the public’s right to provide input in the management of public resources. H.R. 2641 would set arbitrary review deadlines and restrict the range of project alternatives that federal agencies can consider. It would also jeopardize the integrity of the decision-making process by allowing project sponsors to prepare environmental review documents, which is a conflict of interest. Moreover, while presented as an effort to increase timeliness and efficiency, the RAPID Act could actually lead to delays by forcing stakeholders into court preemptively simply to preserve their right to judicial review. On March 6, the House approved H.R. 2641 by a vote of 229-179 (House roll call vote 113). NO IS THE PRO-ENVIRONMENT VOTE. The Senate took no action on this legislation.
